Prelude Systems, Inc., doing business as Prelude Services (“Prelude Services,” “us,” “we” or “our”), owns and operates the website available at preludeservices.com (“Site”). This Privacy Policy (“Policy”) provides details about how we collect, use, share, and otherwise handle information that, alone or in combination with other data, is reasonably capable of identifying or being associated with you (“Personal Information”). This Policy also includes details about certain other data that may be collected whenever you use our Site, or anytime you provide Personal Information or other data in communications to Prelude Services or through other interactions you have with us (collectively with the Site, the “Services”).

This Policy only applies to information we collect from you through the Services identified above. Other websites or online services, including any third-party services you use to interact with Prelude Services, may have their own privacy policies or statements. Prelude Services encourages you to review the privacy policies and statements of any third-party websites or services you choose to link to from Prelude Services so that you can understand how those third-party services collect, use and share your information. Prelude Services is not responsible for the privacy policies and statements or any privacy practices of third-party services outside of Prelude Services and the Services described in this Policy.

By using the Site or our other Services, you consent to the data practices described in this Policy.

Collection of your Personal Information

Depending on how you interact with Prelude Services, there are parts of the Services where you may be asked to voluntarily provide us with Personal Information or other data, or such data may be collected from you in an automated manner as described in the section titled “Use of Cookies,” below. For example, Prelude Services may collect Personally Information such as your email address, name, home or work address, telephone number, and any other Personal Information you voluntarily provide through the Services may be collected from you when you:

  • transmit and respond to requests on or through the Services;
  • contact Prelude Services with questions, comments or other communications;
  • include such information as part of any content or communications you make available through any of our Services;
  • sign up to receive communications about Prelude Services; and/or
  • otherwise provide any information to us through the Services.

Prelude Services also collects demographic information such as your ZIP code, age, gender, preferences, interests and favorites, which generally is not unique to you on its own but to the extent such demographic information reasonably can be linked to you after it is combined with other pieces of information, we will treat such demographic information as Personal Information.

Please keep in mind that if you directly disclose Personal Information, including any sensitive data such as religious beliefs, citizenship status, sexual orientation, or race or ethnicity, through Prelude Services’ public message boards, this information may be collected and used by others. Note: Prelude Services generally will not ask you to provide sensitive data and does not read any of your private online communications, but to the extent you include any sensitive data in communications you voluntarily provide through the Services, you hereby acknowledge and agree that we may process such data as necessary to provide the Services in accordance with your instructions and the terms of this Policy.

Use of Cookies

There also is information about your computer or device hardware and software that is automatically collected by Prelude Services. This information can include your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the Services, to maintain the quality of the Services, and to provide general statistics regarding use of the Services. This automatically collected data generally does not identify any specific individual, but to the extent such data is reasonably capable of being combined with other information and associated with you or another person, we will treat such data as Personal Information.

The Site uses “cookies” in connection with the automatic collection of data described above to help you personalize your online experience. The term “cookie” is commonly used to refer to a text file or other technology that is transmitted to your computer or device by a website server. Cookies cannot be used to run programs or deliver viruses to your computer. Generally, cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time, such as when a cookie is used to tell the web server that you have returned to a specific page. For example, if you personalize Prelude Services pages, or register with our Site or other Services, a cookie helps Prelude Services to recall your specific information on subsequent visits. This simplifies the process of recording your Personal Information, such as billing or shipping addresses and so on. Through the use of such cookies, when you return to the same part of our Site, the information you previously provided can be retrieved, so you can easily use the Prelude Services features that you customized.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of our Services, or other third-party websites you visit.

Prelude Services keeps track of the Site pages and other parts of our Services customers visit when interacting with Prelude Services, in order to determine what Services are the most popular. This data is used to deliver customized content and advertising based on your interactions with Prelude Services to customers whose behavior indicates that they are interested in a particular subject area.

Certain third parties also may directly collect certain Personal Information and other data from you when you use certain parts of the Site or other Services. For example, Prelude Services may use third-party analytics service providers which could automatically collect certain Personal Information and other data about you through the Services including, but not limited to, your IP address and/or other online identifiers. Third-party cookies or other tracking technology may be used through this process to track data such as the times you most frequently use the Services, what devices you use to access the Services, what parts of the Services you visit and the links you use to get there. These data and analytics service providers may use such information to track how you use the Services, measure the performance of the Services, improve features on the Services, and provide Prelude Services with tools that satisfy overall operating needs for the Services. Prelude Services may then use feedback from these service providers to improve the Services and our interactions with you.

Use of your Personal Information

Prelude Services only uses your Personal Information when we have an appropriate basis for doing so, such as to comply with a legal or regulatory obligation, to process transactions or otherwise in performance of a contract, or for our legitimate interests in providing the Services. For example, Prelude Services may use your Personal Information to:

  • inform you of other products or services available from Prelude Services and its affiliates;
  • contact you via surveys to conduct research about your opinion of current Services or of potential new services that may be offered;

By providing to Prelude Services the Personal Information and other data referenced above, you agree that Prelude Services may use the Personal Information and other data in accordance with the terms of this Policy.

Processing by Third-Party Service Providers

Prelude Services may disclose Personal Information to third parties as necessary to fulfill the business purposes for which the Personal Information was collected, as otherwise set forth below, or with the express consent of the user.

Prelude Services does not sell, rent or lease its customer lists or your Personal Information to third parties for profit. Prelude Services may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your Personal Information such as your e-mail, name, address, or telephone number may be exchanged with the applicable business partner.

In addition, Prelude Services may share certain Personal Information and other data with third-party service providers, or we may allow certain service providers to directly access and collect data through our Site such as the analytics providers mentioned above that help us perform statistical analysis related to the usage of our Services. For example, Prelude Services may use:

  • email marketing and other communications providers to send you email or postal mail;
  • customer service providers to perform support services and respond to customer requests; and/or
  • mailing and shipping providers to arrange for deliveries.

All such third-party service providers are prohibited from using your Personal Information except to provide these services to Prelude Services or to help provide our Services to you on our behalf, and they are required to maintain the confidentiality of your information.

Prelude Services does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

Prelude Services will disclose your Personal Information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to applicable requirements of the law or comply with legal process served on Prelude Services or the Site; (b) protect and defend the rights or property of Prelude Services; and (c) act under exigent circumstances to protect the personal safety of users of Prelude Services, or the public.

Personal Information received or held by Prelude Services may be transferred to any entity that succeeds to the assets or business of Prelude Services by any merger, consolidation, combination, reorganization, sale of assets or in connection with any transfer as part of any insolvency or bankruptcy proceeding. In such case, Prelude Services will make reasonable efforts to cause any successor to agree to abide by the terms of this Policy.

We also may disclose your Personal Information to other service providers to carry out our obligations and enforce our rights arising from any contracts related to your use of the Services, including for billing and collections, or as otherwise described to you at or before the point when we collect your Personal Information.

Your Rights and Choices

Depending on where you reside, you may be able to exercise certain rights with respect to Personal Information you provided to Prelude Services, or that Prelude Services may have collected about you, such as rights to:

  • Confirm whether Prelude Services has collected and is processing your Personal Information and, if so, you may have a right to access such data;
  • Correct any inaccuracies about your Personal Information;
  • Request the deletion or erasure of Personal Information you provided to Prelude Services or that we have otherwise collected about you;
  • Obtain a copy of Personal Information Prelude Services maintains about you in a portable and readily usable format, if technically feasible, that would allow you to transfer such Personal Information to another service or provider, where the applicable processing is carried out by automated means;
  • Be protected from adverse treatment by Prelude Services with respect to the prices and quality of our Services because you exercised certain rights regarding the collection, use and sharing of your Personal Information; and
  • Opt-out of any processing of your Personal Information for the purposes of, as applicable, (1) targeted advertising based on your browsing behavior before and after you visit or use the Services, (2) any sale of your Personal Information, if applicable, or (3) any profiling of you based on collected Personal Information in a way that would produce legal ramifications or similarly significant real-world effects on you.

Any removal of Personal Information or other data by Prelude Services does not ensure or guarantee complete or comprehensive removal in all places. The information may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information. Prelude Services will do its best to accommodate any deletion request you make, but Prelude Services cannot guarantee it can remove all Personal Information from the specified uses. Therefore, please be as specific as possible in your request. If the request relates to information that we need to make the Services function properly for you, you may not be able to use the Services properly moving forward.

Prelude Services reserves the right to maintain proper business records with Personal Information as required by law or for other legitimate business purposes to the extent permitted by law, even if such records contain your Personal Information.

If you would like to opt-out of receiving promotional emails from Prelude Services, please follow the opt-out instructions at the bottom of the email or send a detailed email to us using the information at the end of this Policy.

Prelude Services must refuse any request made regarding collected Personal Information if it is unable to verify the identity of the person making the request or if it cannot authenticate the legitimacy of the request using commercially reasonable efforts. Under such circumstances, Prelude Services may follow up with you for additional information as reasonably necessary to authenticate your request. Subject to applicable legal requirements, if Prelude Services refuses to act on a request you make based on the rights listed at the beginning of this section, you may have a right to submit an appeal by contacting us using the same method as when you made the initial request. In the event Prelude Services must deny your appeal, we will provide you with information directing you to forward your complaint to the appropriate legal authorities.

Under certain circumstances, you may grant an authorized agent written permission to submit requests regarding your Personal Information, but we may deny authorized agent requests if we are unable to verify your identity directly as the subject of the Personal Information at issue.

Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable request related to Personal Information in order to verify the requestor’s identity or authority to make the request.

Prelude Services does not knowingly collect any information from minors, and the Site and our other Services are not directed at or intended for minors. If a minor uploads or posts information to the Site that is publicly available, and the minor subsequently wants that same information deleted, the minor has a right to request that said information be removed from public viewing. Any email sent using the contact information at the end of this Policy by such minor or the parent or guardian of such minor with a request to have the information removed will be processed without undue delay and Prelude Services will remove the information. Again, any removal of content by Prelude Services does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information.

Some browsers have a ”do not track” feature that lets you tell websites that you do not want to have your online activities tracked. As referenced above, Prelude Services does not sell any Personal Information collected through the Services, and the Site is not currently configured to respond to “do not track” or similar automated privacy controls. As noted previously in this Policy, it is possible that third parties may collect or receive information through the Services. Since it is possible that some of these third parties may respond differently than Prelude Services to “do not track” requests, you should consult the applicable privacy policies of those third parties for that information.

To learn more about other ways to possibly opt-out of certain kinds of tracking that occur when you browse the internet and lead to targeted advertising, visit the Network Advertising Initiative website and the Digital Advertising Alliance website. Options you select are browser- and device-specific, and there is no guarantee that these industry-provided opt-out tools will prevent all targeted advertising.

Security of your Personal Information

Prelude Services has implemented, uses and maintains industry standard encryption of the Site and other administrative, technical, and physical data security measures that are reasonably designed to secure your Personal Information from unauthorized access, use or disclosure. Prelude Services secures the Personal Information you provide on computer servers in a controlled, secure environment intended for protection from unauthorized access, use or disclosure. When Personal Information is transmitted to other online locations, it is protected through the use of encryption methods such as the Secure Socket Layer (SSL) protocol.

While Prelude Services takes the issue of protecting your Personal Information seriously, you should exercise discretion in what information you disclose or transmit through the Services. Prelude Services cannot guarantee that information sent online is fully secure, and therefore the transmitted information may be intercepted by others before it reaches us. If you are concerned about sending information to Prelude Services over the internet, please send the information by mail or call us to make other arrangements. Prelude Services is not responsible for the security of information sent online.

Prelude Services retains collected information for a reasonable amount of time in order to fulfill the stated purpose for why the information was collected. Prelude Services also will retain collected information connected to business records for periods of time required by law. If Prelude Services determines that collected information is no longer needed, it will delete such information. Prelude Services’ collection times will be consistent with applicable law.

Information from Minors

The Services are intended for individuals 18 years of age and older located in the United States.

The Services are not directed at, marketed to, nor intended for, children under 16 years of age. Prelude Services does not knowingly collect any information, including Personal Information, from children under 16 years of age. If Prelude Services learns that any information was provided through the Services by a person younger than 16 years of age, Prelude Services will delete the information immediately. If you believe any children under the age of 16 may have uploaded or posted information through the Services without authorization, and such information is publicly available, or if you believe Prelude Services might otherwise have information from or about any children younger than 16, please contact us using the information at the end of this Policy.

Prelude Services will not use a minor’s Personal Information to market or advertise certain products or services deemed harmful to children. Prelude Services also will not disclose any minor’s Personal Information if it has actual knowledge that the minor’s Personal Information will be used for the purpose of marketing or advertising such harmful products or services.

International Concerns

The Services are meant for individuals within the United States. Prelude Services only knowingly collects information from individuals within the United States. If you provide information to Prelude Services from outside of the United States, you do so at your own risk. If you are outside of the United States, you are responsible for complying with any local laws regarding use of the Site or our other Services, and any related data collection.

You also agree and acknowledge that by providing any data through the Services, including Personal Information, that such data will be transferred to, and stored in, the United States. Further, your consent to this Policy followed by your submission of such information represents your agreement to that transfer.

If you are located in the European Economic Area (the “EEA,” which includes the 27 European Union Member States, Iceland, Lichtenstein and Norway), Switzerland or the United Kingdom (“UK”) (collectively, the “EU”), or if you are visiting the Site or using our other Services from other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information, you consent to any transfer and processing in accordance with this Policy.

Prelude Services will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy and no transfer of your Personal Information will take place to any organization or country unless there are appropriate controls in place that are consistent with industry standards and applicable laws and regulations, including with respect to the security of your Personal Information and other data.

Changes to this Statement

Prelude Services may occasionally update this Policy from time to time. Since this Policy may change in the event we modify or expand our Services, Prelude Services encourages you to periodically visit the Site and review this Policy to be informed of how Prelude Services is handling your information.

When we update this Policy, we will post a notification on the main page of the Site and update the Policy’s effective date. Any changes will be immediately incorporated into this Policy, and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so.

You acknowledge and agree that it is your responsibility to review this Policy periodically and become aware of modifications. Your continued use of the Services after any changes are made to this Policy constitutes your acceptance of the changes. If any of the changes are unacceptable to you, you should cease using the Services.

If any changes to this Policy significantly affect how Prelude Services treats or handles Personal Information that we have already collected from you, we will endeavor to provide you with notice in advance of such change(s) by highlighting the change on our Site. We will seek your prior consent to any material changes, if and where this is required by applicable data protection laws. If you do not opt-in to such material changes, your information will continue to be used in a manner that is consistent with the version of this Policy under which it was collected, or the information will be deleted.

The Services may contain links to external sites or other online services, including any links that may be embedded in third-party advertisements, all of which are not directly controlled or owned by Prelude Services. Prelude Services is not responsible for the privacy practices and data collection policies for such external sites or online services. You should consult the privacy policies of those third-party services for details.

Prelude Services may also allow interaction between the Services and third-party platforms and other external services online, including social media providers. Such interactions may include buttons and plugins that allow you to share information with others outside of our Services. Please consult the privacy policies of such third-party providers before using them to make sure you are comfortable with the level of sharing. If you do not want social media services to gather information on your usage of our Site or any related Services, please do not interact with the buttons and plugins mentioned above.
